1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of TODAY Type's typing training platform, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

TODAY Type provides a professional typing training platform designed to improve typing speed, accuracy, and efficiency. The Service includes:

• Typing tests and assessments
• Chat simulation exercises
• Performance tracking and analytics
• Training programs and learning paths
• Team management and reporting tools

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access to your account.

4. Acceptable Use

5. Subscription and Payment

5.1 Plans and Pricing

The Service is available under various subscription plans. Current pricing is available on our Pricing page. We reserve the right to modify pricing with reasonable notice.

5.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all fees incurred.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

5.4 Enterprise Agreements

Enterprise customers may be subject to additional terms specified in separate agreements.

6. Intellectual Property

6.1 Our Content

The Service and its content, including software, text, graphics, logos, and training materials, are owned by TODAY Type and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

6.2 Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a license to use, store, and process that content to provide the Service.

6.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to you.

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

For enterprise customers, data handling may be governed by additional agreements such as Data Processing Agreements (DPAs).

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for:

• Scheduled maintenance
• Emergency repairs
• Circumstances beyond our control

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be error-free, or produce specific results in typing improvement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TODAY TYPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TODAY Type, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice. Upon termination:

• Your right to use the Service ceases immediately
• You remain responsible for any outstanding payments
• Data retention is subject to our Privacy Policy

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and TODAY Type.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent.
